Terms and conditions

1. Seller identity

2. Purpose and scope

These Terms govern access to grokachu.fr, use of its account and browsing services, and online sales by Grokachu. They apply to every order confirmed on the Site. By ordering, the Customer confirms that they have read and accepted them. Grokachu may amend these Terms; the version in force on the order date applies.

3. Products sold

Grokachu sells trading cards, booster packs, sealed boxes, figures, collection boxes and accessories, mostly imported from Asian markets. Products are new unless expressly stated otherwise. Minor packaging, language or artwork differences may exist between markets and do not in themselves constitute a lack of conformity.

4. Customer account

Creating an account is optional but recommended for order tracking. The Customer must provide accurate, current information and remains responsible for keeping login details confidential. Grokachu may suspend or delete an account in cases of fraud, breach of these Terms or abusive behaviour.

5. Site use and intellectual property

The Customer must use the Site fairly and lawfully. Ordering bots, scripts, attempts to bypass purchase limits, disruption of the Site and unauthorised access are prohibited. Site content is protected by intellectual property law. Named trademarks remain the property of their owners. Grokachu is an independent retailer.

6. Prices

Prices are shown in euros including tax. Delivery costs are shown before confirmation. The applicable price is the one displayed when the order is confirmed. If a price is clearly erroneous, Grokachu may cancel the order and issue a full refund.

7. Orders

Confirming an order creates an obligation to pay. A confirmation email is sent after payment validation and stock checks. Grokachu may refuse, suspend or cancel an order where fraud, non-payment, inaccurate information, speculative resale or circumvention of purchase limits is suspected.

8. Preorders

A preorder reserves a product before its official release. Availability dates are estimates and may change. If the Customer cancels before dispatch, costs genuinely incurred by Grokachu may be deducted from the refund where evidence is provided.

9. Payment

Payment is due when the order is placed, by card through Stripe. Banking data is handled by the payment provider and is neither accessible to nor stored by Grokachu. Identity verification may be requested where fraud is suspected.

10. Delivery

Orders are delivered to the address entered at checkout. Delivery times are estimates. Grokachu is not liable for delays caused by the carrier or force majeure. Risk transfers when the Customer or their nominated third party physically receives the parcel.

11. Checks on delivery and claims

The Customer must inspect the parcel on delivery. Visible damage must be reported to the carrier and Grokachu within 48 business hours, with photos of the packaging and contents. For a dispute about missing or incorrect contents, a continuous opening video may be requested.

12. Sealed products — specific TCG rule

Sealed products are sold as supplied; their contents are random and determined by the manufacturer. No particular card, rarity or value is guaranteed. A product that has been unsealed, opened, damaged or has compromised wrapping cannot be returned or refunded, in accordance with Article L221-28 of the French Consumer Code.

13. Protection against tampering and resealing

Grokachu inspects, weighs and may photograph products before dispatch. Returns are checked in detail. If resealing, substitution or fraud is suspected, a refund may be refused and the account suspended. Orders placed to bypass a restriction may be cancelled.

14. Imported products

Imported products may differ from European equivalents in packaging language, local distributor logos, regulatory wording or format. These characteristics are shown on product pages and do not constitute a lack of conformity.

15. Right of withdrawal

The Customer has 14 days after delivery to exercise the statutory right of withdrawal, except for unsealed products. Email contact@grokachu.fr to obtain a return number. Return postage is paid by the Customer unless Grokachu supplied an incorrect or defective product.

16. Returns and refunds

Returned products must be complete, in intact original packaging and in perfect condition. Grokachu may refuse a non-compliant return or apply a reduction for loss of value. Refunds are made within 14 days after receipt and inspection, using the original payment method. Initial delivery costs are not refunded.

17. Statutory warranties

Products benefit from the French statutory warranty of conformity and warranty against hidden defects. To make a claim, email contact@grokachu.fr.

18. Disputes and mediation

Any dispute should first be raised with Grokachu support to seek an amicable solution. If no agreement is reached, the Customer may use a consumer mediator. In the event of an abusive chargeback without prior contact, Grokachu may suspend the account and provide relevant evidence to the payment organisation.

19. Personal data

Browsing and order data is processed under the GDPR. Full details appear in the Privacy policy. For any data request, email contact@grokachu.fr.

20. Liability

Grokachu is not liable for indirect loss, loss of business, carrier delays, force majeure or misuse of a product. In all cases, Grokachu’s liability is limited to the value of the order concerned.

21. Governing law

These Terms are governed by French law. Once amicable remedies have been exhausted, the competent French courts have exclusive jurisdiction.
